Work experience

Kevin Duan is a partner at Han Kun Law Offices.  His practice focuses on data protection and cybersecurity, artificial intelligence and technology regulation, intellectual property, and complex technology-related disputes.
Kevin regularly advises multinational corporations, leading Chinese enterprises and innovative technology companies on complex, technology-driven and cross-border legal and regulatory matters.  His experience spans a broad range of technology-intensive sectors, including internet and digital platforms, artificial intelligence, connected and autonomous vehicles, semiconductors, life sciences and healthcare, financial services, and consumer technologies.
In the areas of data protection and cybersecurity, Kevin has extensive experience advising on personal information protection, data security governance, cross-border data transfers, cybersecurity reviews, personal information protection compliance audits, data incident response, and the design and implementation of enterprise-wide data compliance programs.  He has led a number of high-profile cybersecurity review, overseas listing, and cross-border data projects and frequently helps multinational companies reconcile PRC regulatory requirements with their global privacy and data governance frameworks.
Kevin is also at the forefront of artificial intelligence and emerging technology regulation in China.  He advises leading foundation model developers, generative AI companies, cloud service providers, smart-device manufacturers and internet platforms throughout the lifecycle of their AI products and services.  His work covers training data and data provenance, model and algorithm compliance, AI-generated content governance, open-source software and model licensing, intellectual property, product design and launch, algorithm and generative AI filings, AI ethics, product liability, technology export controls, and overseas deployment.  He is particularly experienced in analyzing interrelated data, IP, content regulation and cross-border issues arising from complex AI architectures and business models and translating them into practical solutions.
In his intellectual property practice, Kevin handles both contentious and transactional matters, including patent infringement and invalidation proceedings, trade secret disputes, software and copyright matters, IP licensing, technology collaborations, open-source compliance, and IP due diligence.  His engineering background enables him to engage closely with the underlying technologies and to work effectively across legal, engineering, product, and business teams.
Kevin has substantial experience in cross-border disputes and international regulatory matters involving China, the United States, Europe, and other major jurisdictions.  He has also provided expert evidence on PRC data protection and cybersecurity law in overseas judicial proceedings.  Kevin regularly speaks on cross-border data flows, AI governance, intellectual property, and technology regulation at international legal and industry forums, including programs organized by the American Bar Association and The Sedona Conference.
Before entering legal practice, Kevin was engaged in academic research for nearly ten years and published more than ten peer-reviewed academic papers.  His multidisciplinary background in engineering, law, and scientific research allows him to bridge law, technology, and business and to advise clients on some of the most complex legal questions arising from emerging technologies.
